On the morning of June 12, the 20th meeting of the Standing Committee of the 13th Shandong Provincial People’s Congress reviewed and approved the “Shandong Provincial Standardization Regulations” (hereinafter referred to as the Regulations). The regulations include 6 chapters and 40 articles, which respectively provide provisions for standard formulation, standard implementation, supervision and services, and will be implemented on August 1, 2020. Let’s take you through the highlights of the regulations.

Aspect 1: Maintain the unity of the legal system and supplement and refine relevant provisions of higher-level laws

This regulation first further expands the scope and connotation of application. The scope of application extends from the original fields of industry, engineering construction, and environmental protection to various fields of industry, agriculture, service industry, and social undertakings development. Its connotation also adds content to group standards and municipal-level local standards based on the previous ones, further highlighting the role of standards.

In addition, the regulations further improve the standard work management mechanism and clarify the responsibilities of the government and its relevant departments. The regulations stipulate the government’s responsibilities in standardization work, including promoting the implementation of standardization strategies, incorporating standardization work into the national economic and social development plan at the same level, improving standardization support and reward policies, and establishing a standardization coordination mechanism.

Point 2: Focus on institutional innovation and improve standard innovation mechanisms

In order to promote high-quality development, the regulations focus on institutional innovation and further improve the standard innovation mechanism. The first is to put forward the requirements for the construction of enterprise joint standards. The regulations stipulate that enterprises are encouraged to develop joint enterprise standards for common use to improve the quality of products or services. Enterprise joint standards are enterprise standards jointly formulated and used jointly by enterprises in the same industry or upstream and downstream enterprises in the supply chain in order to strengthen industrial collaboration and technical cooperation. The regulations clearly encourage the formulation of enterprise joint standards, which is of great significance for relevant industries and enterprises to jointly promote the research and development and application of advanced technologies and improve product quality or service quality.

It is worth noting that the regulations also bring the “front-runner” standard system into the legal track for the first time, and propose to promote the implementation of the “front-runner” standard management system. In accordance with the regulations, a “front-runner” system for corporate standards will be implemented in the future. Support the transformation of advanced standards of enterprises with independent innovative technologies and good implementation results into “leader” standards in the industry. This will help focus on solving the problem of the lack of advanced standards in industrial transformation and upgrading, accelerate the establishment of a supply mechanism for advanced standards, and use advanced standards to promote the conversion of old and new driving forces and industrial transformation and upgrading.

In addition, according to the current actual situation in Shandong, some areas do not yet have the conditions to formulate local standards, but need to provide guidance on technical requirements. In response to this situation, the regulations introduced a local standardization guiding technical document system. It is stipulated that the standardization guiding technical documents can be formulated with reference to the local standard setting procedures and rely on the local standardization guiding technical documents. This will help meet the development needs of new technologies, new industries, new business formats, new models, etc., and will also be conducive to the timely promotion and application of scientific and technological innovation technologies.

Point 3: Deepen the reform of “delegation, regulation and services” in the field of standardization and improve the level of standard public services

This regulation also involves how to correctly handle the relationship between the government and the market, proposing to deepen the reform of “decentralization, regulation and service” in the field of standardization, and further improve the level of standard public services. Specifically, the regulations distinguish between the requirements of local standards, group standards, and enterprise standards, stipulating that the technical requirements of local standards shall not be lower than the relevant technical requirements of mandatory standards and recommended national standards, and the technical requirements of group standards and enterprise standards shall not be lower than the relevant technical requirements of mandatory standards.

In accordance with the requirements of the “delegation, regulation and service” reform, the regulations also clarify that cities divided into districts can formulate local standards, and provide specific specifications for the project establishment, review numbering and issuance of local standards.

In addition, in order to further improve the level of standard public services, the Regulations also provide specific specifications for the construction of standards in the basic public service industry. In the future, people’s governments at or above the county level should improve the basic public service standard system, improve basic public service standards, implement national basic public service quality requirements, and innovate the implementation mechanism of basic public service standards, so as to promote the equalization, universal benefit and convenience of basic public services through standardization.
